These Terms & Conditions ("Terms") govern your access to and use of the Cloudonpoint website (the "Site") and the services we provide. By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

In these Terms, "we", "us" and "our" refer to Cloudonpoint; "you" and "Client" refer to any person or entity accessing the Site or commissioning our services; "Services" means the architectural visualisation, project websites and sales-communication services we provide; and "Deliverables" means the materials we produce for you.
Cloudonpoint provides architectural visualisation, project websites and structured sales communication for real-estate and construction projects. The precise scope, deliverables, milestones, timeline and price of any engagement are agreed in a separate written proposal, quotation or contract, which prevails over these Terms in the event of conflict.
You may use the Site for lawful purposes only. You agree not to use it in any way that breaches applicable law, attempt to gain unauthorised access to the Site or its systems, introduce malicious code, or copy, reproduce or exploit any part of the Site except as expressly permitted. We may suspend or restrict access to the Site at any time without notice.
Quotations are valid for the period stated in the proposal. Unless agreed otherwise, fees are exclusive of VAT and payable in Swiss francs (CHF) within the period indicated on the invoice. Late payment may incur default interest at the statutory rate. We may suspend work or withhold Deliverables until outstanding invoices are settled.
To enable us to deliver the Services, you agree to provide accurate and complete information, plans, assets and feedback in good time, and to obtain all rights, licences and permissions for any material you supply to us. Delays caused by missing or late input may affect timelines and costs.
All content on the Site — including text, imagery, visualisations, graphics, design and code — is owned by or licensed to Cloudonpoint and protected by Swiss and international intellectual-property laws. Rights in project Deliverables transfer to you as set out in the applicable proposal, typically upon full payment; until then, all rights remain with Cloudonpoint. We may reference completed work in our portfolio unless agreed otherwise in writing.
Each party shall keep confidential any non-public information disclosed by the other in connection with an engagement and use it only for the purposes of that engagement. This obligation survives the end of the engagement.
The Site may contain links to third-party websites or resources provided for convenience only. We do not control and are not responsible for their content, products or practices, and a link does not imply endorsement.
We provide the Services with reasonable skill and care. Except as expressly stated, the Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, secure or error-free.
To the maximum extent permitted by Swiss law, Cloudonpoint shall not be liable for any indirect, incidental or consequential loss, or for loss of profit, data or business, arising from the use of the Site or the Services. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for unlawful intent or gross negligence.
You agree to indemnify and hold Cloudonpoint harmless against any claims, losses or costs arising from your breach of these Terms or from any material or instructions you provide to us.
These Terms apply for as long as you use the Site. Engagement-specific terms, including duration and termination, are governed by the applicable proposal or contract. We may terminate or suspend your access to the Site if you breach these Terms.
We may update these Terms from time to time. The "Last updated" date below reflects the most recent version, and your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for any dispute is Zug, Switzerland, subject to any mandatory legal venue.
